These general conditions of sale govern all relations between:

1 / Special conditions of sale

The customer acknowledges having read, at the time of placing the order, the specific conditions of sale stated on screen (name, price, components, weight, quantity, color, particularities of products, cost of services, etc.) and expressly states accept them without reservation. The placing of the order and its confirmation by the customer, materialize its full acceptance of the particular conditions of sale, only applicable to the order.

2 / Products

The photographs illustrating the products offered do not enter the contractual field. If errors are introduced, under no circumstances, the responsibility of LINDA VIDA can not be committed. It is the responsibility of the Purchaser to check with the local authority of his country for possible restrictions on the importation and use of the products he intends to order.

3 / Order

The customer places an order by clicking on the “add to cart” tab. The order is the subject of a summary containing all the elements that the customer confirms by clicking on the button “I accept the GTC and I pay” in the menu bar.

LINDA VIDA automatic registration systems are considered as proof of the nature, content and date of the order. Any order exceeding 500 Euros (cost of goods including VAT) must be subject, to the exclusion of any other order, sending LINDA VIDA the printing of the order form on the screen, duly signed by the client. These general conditions of sale in paper form must be attached, also duly signed by the customer. Failing this, any order higher than this amount will not be taken into account and will not be legally valid.

4 / Confirmation of the order

LINDA VIDA confirms the acceptance of its order to the customer according to one of the following means of its choice: email, fax or mail. The sale will not be concluded until the confirmation of the order by LINDA VIDA.

LINDA VIDA reserves the right not to confirm an order in particular circumstances, related to the supply of products, a problem concerning the order received (ex .: illegible document), an abnormal order … LINDA VIDA will inform the customer by all means.

Any new order will be able to intervene only after regular payment by the customer of the sums due under his previous orders. The same will apply to the transfer of ownership of the merchandise, which will be complete only upon receipt of the sums owed by the customer to Linda Vida.

5 / Availability of orders and delivery conditions

The place and the date of availability of the goods are chosen by the customer when ordering. LINDA VIDA reserves the right to use any logistics provider at its convenience to deliver the products to the address specified by the customer. Deliveries are made in the territory of Metropolitan France as well as the geographical areas served by the carrier.

6 / Terms and Delivery Times

Delivery will be made by post or by carrier.

Delivery is made within 3 to 5 working days (for Metropolitan France) from the receipt of your payment, subject to availability of products, to the address specified by the customer.

In case of absence, the Buyer will withdraw the package according to the terms proposed by the deliveryman.
Possible delays do not entitle the Buyer to claim damages.
The maximum delivery time after a purchase on the internet is 30 days. Beyond this limit the customer can request a full refund of the amount he has paid either by check or transfer or by purchase order.

In the case of a technical product, the Buyer will take special care to check the proper functioning of the delivered device, read the instructions for use provided. In case of apparent defects, the Buyer has the right of return under the conditions provided for in Article 14.
The goods always travel at the risk of the recipient.

The Buyer is obliged to check his parcel on arrival. It has a period of 24 hours to make any reservations with the carrier in case of default or degradation. For reasons of availability, LINDA VIDA will be able to deliver an order in several times. However, the Buyer will only pay for one delivery.

If the Buyer wishes 2 places of delivery, he places 2 orders, and pays the delivery charges for each of the two orders.

7 / Delivery costs and provision of orders

Delivery charges are defined based on the carrier selected and the geographic area of ​​the buyer. In metropolitan France for any basket greater than or equal to € 70, excluding delivery charges, these will be offered (ie carriage paid € 70)

By placing an order, if the customer chooses the method of delivery against signature, the latter undertakes to sign the delivery slip presented by the deliveryman, on which he can make any remark he deems necessary. Customers who find damaged or missing products must complain to LINDA VIDA Customer Service by e-mail within 24 hours maximum.

All events, such as force majeure, disaster, strike, administrative decision or transport stoppage, which would tend to delay, prevent and render exorbitant the execution of the supply constitute, by express agreement, a clause of suspension or suspension of extinction of NATURE AND SHARING obligations, without indemnity for the benefit of the client if the event extends beyond 15 days. When the delivery of the goods to the customer is not possible because of the latter, LINDA VIDA reserves the right to charge a fixed contribution to the preparation costs of 19 € TTC.

8 / Carrier

Deliveries are made by LA POSTE COLISSIMO during normal business hours. Please select the shipping address, so that someone can receive the package.

9 / Price

All prices quoted are in Euros and include French VAT (5.5% or 20%). The price charged to the customer is the price indicated on the order confirmation sent by LINDA VIDA. The payment of products and services is done by credit card, in a secure environment on the server of our provider. The customer’s credit card will be debited in Euros immediately after the acceptance of the order by LINDA VIDA who retains ownership of the product (s) until full payment of the price of the product (s). 12 / Warranty

In case of any problem, the Buyer can contact the Customer Service via the contact form.

The Buyer benefits from the legal guarantee against latent defects (Article 1625 and following of the French Civil Code), the products sold benefit from a guarantee of the manufacturer whose duration is indicated in the notices of each product.

These warranties are exclusive of any other guarantee of result as to the satisfaction of the specific needs of the Buyer.

Provided that the Buyer proves the hidden defect, LINDA VIDA must legally repair all the consequences (Article 1641 and following of the Civil Code); if the Buyer goes to court, he must do so within a “short time” from the discovery of the hidden defect (Article 1648 of the Civil Code).

LINDA VIDA guarantees its products. In case of incident, and after being informed by email within 24 hours after delivery, LINDA VIDA fully refunds the returned products to the care of the Buyer, if the problem is proven.

13 / Litigation

This contract is subject to French law.

LINDA VIDA can not be held responsible for damage of any kind, whether material or immaterial or bodily, that could result from a malfunction or misuse of the products marketed. The same is true for any modifications of the products resulting from the manufacturers.

The liability of LINDA VIDA will, in any case, be limited to the amount of the order and can not be blamed for simple errors or omissions that may have remained despite all the precautions taken in the presentation of the products.

It is recalled that the respect of the provisions of this contract relating to the contractual guarantee supposes:

14 / Right to return the goods and withdrawal period

The Buyer has a statutory withdrawal period of 14 (fourteen) working days (articles L.121-20 and following of the Consumer Code revised by the Hamon law) from the receipt of products.
